Website Terms and Conditions of Use

1. Rules
   While visiting the Books Galore Site, you may not:
   • Post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offence or give rise to civil liability, or otherwise use the Books Galore Site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Books Galore Site or the Internet.
   • Post or transmit any information or software, which contains a virus, trojan horse, worm or other harmful or disruptive component.
   • Upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Books Galore Site which is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or right holder.
   
   
2. Monitoring
   Books Galore has no obligation to monitor the Books Galore Site. However, you agree that Books Galore has the right to monitor the Books Galore Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Books Galore Site properly, or to protect itself or its subscribers. Books Galore will not intentionally monitor or disclose any private electronic-mail message unless required by law. Books Galore reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.
   
   
3. Privacy
   Books Galore cannot ensure or guarantee privacy for Books Galore users. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and Books Galore and its affiliates, suppliers and related companies shall be relieved of all liability in connection therewith.
   
   
4. Buying over the Internet
   When making purchases or conducting other transactions through the Books Galore Site or the Internet, you may be asked by the Merchant or Information or Service Provider, to supply certain information, including credit card or other payment mechanisms. You agree that all information you provide any merchant or Information or Service Provider through the Books Galore Site will be accurate and complete. You agree to pay all charges incurred by you or other users of your account or credit card or other payment mechanisms at the prices in effect when such charges are incurred. You also will be responsible for paying all applicable taxes, if any, relating to purchases on the Books Galore Site. Books Galore is in no way responsible for any charges you or any user of your account incurs when making purchases or other transactions in this manner.
   
   
5. Agreement of Sale
   Placing a product in a shopping basket without completing the purchase cycle does not:
   
   • constitute an agreement of sale; and/or constitute an order for such product,
   • and as such, Books Galore may remove such product from the shopping basket no stock is available and you may not hold Books Galore liable if such product is not available when the purchase cycle is completed at a later stage.
   
   An agreement of sale only comes into effect if and when:
   
   • The purchaser electronically submit a properly completed order for one or more products in the purchasers shopping basket; and payment is either authorised, or received by Books Galore in its bank account.
   
   
   
6. Termination of Sales & Cancellation of Orders
   Books Galore reserves the right, whether for purposes of preventing suspected fraud or otherwise, to refuse to accept, or process payment on, any order and/or to cancel any sale concluded between the purchaser and Books Galore, in whole or in part, without giving any reasons.
   
   Books Galore shall only be liable to refund monies already paid by the purchaser (see Books Galore Refund Policy in this regard), and accepts no other liability which may arise as a result of such refusal to process any order/sale.
   
   
7. Amounts Payable
   Prices:
   • The price of each product is displayed with the product listing. In the event of a sale or special offer, the discounted price is displayed. VAT at 14% is included in the price.
   Delivery Charges:
   • Delivery is by South African Post Office Counter to Counter only, within the borders of South Africa only. The cost will be a standard R20-00 per parcel irrespective of the number of books or weight of the parcel. Delivery cost will be added to the final order total.
   Errors:
   • Books Galore shall take all reasonable efforts to accurately indicate prices and delivery charges. However, should products be erroneously offered at incorrect prices and/or delivery charges, Books Galore will not be obliged to sell products at such incorrect prices and/or delivery charges and shall only be liable to refund monies paid should you not wish to proceed with the purchase at the correct price and/or delivery charge
   
   
8. Payment Methods
   Books Galore utilises a third party payment gateway, namely PayGate.
   Payment options are by credit card or by EFT.
   Transactional security is provided by PayGate.

9. Deliveries
   Delivery is by South African Post Office Counter to Counter only, within the borders of South Africa only. The cost will be a standard R20-00 per parcel irrespective of the number of books or weight of the parcel. Delivery cost will be added to the final order total.
   
   Alternatively orders may be collected at a store nominated at checkout, at no charge. Buyers will be advised via email when their order is ready for collection.
   
   Orders will be shipped on receipt of payment, and should reach the recipients Post Office Counter between 1-2 weeks from receipt of order, subject to the South African Post Office service.
   
   Customers will be advised of the postage tracking number by email.
   
   
10. Availability
    Availability is assumed correct on receipt of order. Should an item not be available after purchase , Books Galore with refund the purchaser with the sale price.
    
    
11. Returns
    If a customer is not satisfied with a product purchased from the Books Galore website, it may be returned for refund within 7 days of the shipment date , with the following provisions:
    • Books may only be returned if defective, damaged or if the book supplied is not the same as was ordered. Note that the cover not being the same as the image on the site does not constitute the book being different from what was ordered if the content is the same. All cover images on the site are for illustrative purposes only, and may not match the actual product. If a book is defective or damaged it will be replaced with a new copy of the same book.
    • If it is apparent that the defect is a print error then the item will be credited.
    
    If after Books Galore receives a returned book, and upon evaluation the item is determined not to be defective or damaged, or if the book is what was ordered, a handling fee of 10%, as well as the shipping costs to and from Books Galore, will be payable before the item is returned to the customer.
    
    
12. Limitation of Liability
    Books Galore takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics on the Books Galore Site. Further, Books Galore makes no representations about the suitability of any of the information contained in documents and related graphics on the Books Galore Site for any purpose. All such documents and related graphics are provided without warranty of any kind. In no event shall Books Galore or its suppliers or affiliates be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available from the service.
    
    
13. Recourse
    If you are dissatisfied with the Books Galore Site or with any terms, conditions, rules, policies, guidelines, or practices of Books Galore in operating the Books Galore Site, your sole and exclusive remedy is to discontinue using the Books Galore Site.
    
    
14. Confidential Information
    You authorise Books Galore to collect from any party and to retain all relevant information relating to your use of the Books Galore Site, and you hereby authorise any party to provide us with such information.
    
    
15. Indemnity
    You agree to defend, indemnify and hold Books Galore and its affiliates, suppliers and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of this Agreement by you or users of your account, or in connection with the use of the Books Galore Site or the Internet or the placement or transmission of any message, information, software or other materials on the Books Galore Site or on the Internet by you or users of your account.
    
    
16. Trademarks
    Books Galore and other trade marks, logos and icons identifying Books Galore and Books Galore products and services referenced herein are trademarks or registered trademarks of Books Galore. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.
    
    
17. Miscellaneous
    This Agreement, including any and all documents referenced herein, constitute the entire agreement between Books Galore and the user pertaining to the subject matter hereof. Books Galore's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement were determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the prevailing laws of South Africa.
